Terms & Conditions

 

Important Notice

By booking, engaging, or using services provided by The Old School Cleaning Co. (‘OSCC’, ‘we’, ‘us’), you agree to the following Terms & Conditions. These Terms & Conditions operate alongside the OSCC Service Agreement (LEG-001) and apply to all residential and commercial cleaning services.

1.  SERVICES

1.1  OSCC provides residential, commercial, Airbnb and short-stay, NDIS and specialist cleaning services as agreed in writing via quote, booking confirmation or ongoing service arrangement.

1.2  Only tasks agreed in writing form part of the service scope.

1.3  OSCC may engage trained employees or independent contractors to perform services.

1.4  All personnel engaged by OSCC are appropriately insured and authorised to perform services on behalf of OSCC.

2.  QUOTES & PRICING

2.1  All pricing is provided via written quote, service schedule or booking confirmation.

2.2  All prices are inclusive of GST where applicable unless otherwise stated.

2.3  OSCC reserves the right to adjust pricing where:

         Property condition differs from description provided

         Scope of work changes

         Ongoing services are reviewed with notice

2.4  Quotes and fixed-price services assume the property is in a normal, reasonably maintained condition for the service booked. Where a property is significantly more soiled than described, or in a write-off condition (for example excessive rubbish, hoarding or biohazard), OSCC may reassess the scope and re-quote before proceeding.

2.5  No variation to a booking or the agreed scope is binding unless confirmed in writing by OSCC.

3.  PAYMENT TERMS

3.1  Residential Services: payment is due on the day of service unless otherwise agreed.

3.2  Commercial Services: payment is due within seven (7) days of invoice unless otherwise agreed.

3.3  OSCC reserves the right to:

         Suspend or cancel services for non-payment

         Require upfront payment for future bookings

         Refer overdue accounts to debt collection

         Recover reasonable administrative, legal and debt recovery costs

3.4 A late payment fee of $25 may be applied to accounts outstanding more than seven (7) days.

3.5 Accounts remaining unpaid for more than thirty (30) days may incur interest on the outstanding balance at a rate of twelve percent (12%) per annum, calculated daily and charged monthly.

3.6 OSCC reserves the right to suspend ongoing or future services until all overdue amounts are paid in full.

3.7 OSCC may require or offer payment by card-on-file, direct debit or other automated payment method for recurring or ongoing services. By providing payment details through a secure third-party payment provider, you authorise OSCC to charge the agreed service fees and, where applicable, approved cancellation fees, no-access fees, late payment fees and any other amounts payable under these Terms and Conditions.

3.8 Payment information is processed and stored by OSCC’s nominated third-party payment provider. OSCC does not store full payment card details and takes reasonable steps to ensure payment information is handled securely and in accordance with applicable privacy laws.

3.9 Clients are responsible for ensuring payment details remain current and valid. Where a payment is declined, dishonoured or otherwise unsuccessful, OSCC may suspend services until payment is successfully received and may recover any reasonable administration or processing costs incurred.

3.10 OSCC reserves the right to require a valid card-on-file or approved automated payment method for recurring or ongoing services. Failure to maintain a valid payment method may result in the suspension, rescheduling or cancellation of future services until satisfactory payment arrangements have been made.

4.  DEPOSITS

4.1  OSCC reserves the right to request a deposit or upfront payment for certain bookings including but not limited to deep cleans, bond cleans commercial work or high-demand periods.

4.2  Where a deposit is paid, it secures your booking and is applied to your final service fee.

4.3  If you cancel or reschedule with less than 24 hours’ notice, or OSCC cannot gain access on the day, the deposit may be forfeited or applied toward the cancellation fee under clause 5. Nothing in this clause limits your rights under the Australian Consumer Law.

5.  CANCELLATIONS & RESCHEDULING

5.1  A minimum of 24 hours’ notice is required to cancel or reschedule.

5.2  Less than 24 hours’ notice: 50% of service fee applies.

5.3  No access or no-show: 100% of service fee applies.

5.4  Repeated cancellations may result in termination of ongoing services.

5.5  Cancellation and no-show fees may be charged to a card on file or invoiced for immediate payment. ‘No access’ includes OSCC being unable to enter the property, the property being unsafe to enter, or pets not being secured as required.

5.6  OSCC may occasionally need to cancel or reschedule a booking, for example due to staff illness, equipment failure, unsafe conditions, or circumstances beyond our control. Where this happens, we will give you as much notice as is reasonably practicable and arrange the earliest alternative time that suits you. No cancellation or no-show fee applies where OSCC cancels or reschedules. Any amount paid in advance will be credited to the rescheduled service or refunded if the service does not proceed. To the extent permitted by law, OSCC is not liable for any indirect or consequential loss arising from a cancellation or rescheduling by OSCC.

6.  ACCESS & SAFETY

6.1  Clients must provide safe and unobstructed access to the property at the scheduled time.

6.2  Electricity and running water must be available.

6.3  Aggressive or unsafe pets must be secured.

6.4  OSCC reserves the right to refuse or discontinue service where conditions are unsafe or unsuitable, including where aggressive or unsafe animals are present, where hazardous materials are present, or where there is a risk to staff or property. Where work cannot proceed safely, full-service fees may apply.

6.5  Where you provide keys, access codes, alarm codes or a lockbox, OSCC will keep these secure and use them only to perform the agreed service. Keys are never labelled with your name or address.

6.6  If you are not present, you must provide a secure method of access, such as a lockbox or a supplied code. If OSCC cannot gain access, the no access terms in clause 5 apply.

6.7  OSCC is not responsible for loss or damage where access arrangements are left to OSCC’s control against these terms, where doors or alarms are left unsecured by you or others, or where third parties you have authorised enter the property during or around the service.

6.8  You are responsible for providing accurate property and service information, disclosing any hazards before the service, ensuring safe working conditions, and putting away or pointing out any fragile, delicate or irreplaceable items beforehand so our team can clean around them with care.

7.  SATISFACTION & RE-CLEANS

7.1  If you are dissatisfied with a service, you must notify OSCC within 24 hours of completion.

7.2  OSCC will assess the concern and may arrange a return visit to address specific issues at its discretion.

7.3  All remedies are provided subject to your rights under the Australian Consumer Law.

7.4  To support a re-clean request, OSCC may ask for clear, timestamped photographs of the areas concerned.

7.5  A re-clean addresses the specific items or areas raised. It is not a full re-clean of the property and is provided once per service.

7.6  Re-cleans do not cover pre-existing damage or soiling, issues caused by third parties or by use of the property after the service, ordinary wear and tear, or expectations beyond the agreed scope.

8.  DAMAGE & LIABILITY

8.1  OSCC takes reasonable care when performing services.

8.2  Claims for damage must be reported within 24 hours.

8.3  OSCC will, at its discretion: repair the item, or arrange replacement of like-for-like value.

8.4  OSCC is not liable for:

         Pre-existing damage

         Wear and tear

         Faulty fixtures or installations

         Undisclosed fragile items

         Fragile or irreplaceable items that were not put away or pointed out before the service

8.5  Clients acknowledge that certain surfaces and materials may react unpredictably to cleaning products or agitation, particularly where pre-existing wear, improper sealing or latent defects exist. OSCC is not liable for damage arising from such conditions where reasonable care has been exercised.

8.6  To the maximum extent permitted by law, OSCC’s liability is limited to the re-supply of the services or the cost of having the services supplied again. OSCC is not liable for indirect, consequential, special or economic loss, including loss of rental income, business interruption or loss of use.

8.7  Nothing in these terms excludes rights under Australian Consumer Law.

8.8  Where permitted under section 64A of the Australian Consumer Law, OSCC’s liability is limited to supplying the services again or paying the cost of having the services supplied again.

9.  SCOPE LIMITATIONS

9.1  Unless specifically agreed in writing, services do not include:

         Mould remediation

         Biohazard removal

         Hazardous waste removal

         Structural repairs

         Heavy lifting beyond safe limits

         External or outdoor areas unless quoted

9.2  Additional tasks outside agreed scope may incur additional charges.

10.  NON-SOLICITATION OF STAFF

10.1  Clients agree not to directly or indirectly employ, engage or solicit OSCC staff or contractors during service engagement and for twelve (12) months following termination of services without written consent from OSCC.

11.  PRIVACY

11.1  Client information is collected for the purpose of providing services and managing bookings.

11.2  OSCC respects client privacy and will not disclose personal information except where required to provide services or by law.

11.3  A full Privacy Policy is available on the OSCC website and in document LEG-003.

12.  FORCE MAJEURE

12.1  OSCC is not liable for delays or failure to perform services due to events beyond reasonable control including severe weather, illness, emergency or government restrictions.

13.  BOND & END-OF-LEASE CLEANS

13.1  Bond and end-of-lease cleans are quoted and booked specifically as such. Any bond guarantee offered by OSCC applies only to services booked as a bond or end-of-lease clean.

13.2  For an accurate quote, OSCC may request photographs of the property before the service, including the oven, showers, window tracks and walls.

13.3  Before the service, the property must be empty of rubbish and personal belongings, with furniture removed, any included gardens or outdoor areas maintained, and power and water connected.

13.4  Any bond guarantee is valid only where no person other than the property manager or agent enters the property between the clean and the final inspection, and where any issue is reported within the timeframe set by the agent or required under the tenancy.

14.  INDEMNITY

14.1  To the extent permitted by law, you agree to indemnify OSCC against any loss, damage, cost or liability OSCC suffers arising from your failure to disclose a known hazard, your failure to provide safe and lawful access, incorrect or incomplete information you provide about the property, or the acts of third parties you have allowed on site.

14.2  This clause does not apply to loss or damage caused by OSCC’s own negligence or breach, and nothing in it limits or excludes your rights under the Australian Consumer Law.

15.  CHANGES TO THESE TERMS

15.1  OSCC may update these Terms & Conditions from time to time. The current version is available on the OSCC website or on request.

15.2  Continued use of OSCC services after an update constitutes acceptance of the updated Terms.

16.  SEVERABILITY

16.1  If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

17.  GOVERNING LAW

17.1  These Terms & Conditions are governed by the laws of Queensland, Australia.

17.2  These Terms & Conditions operate in conjunction with the OSCC Service Agreement (LEG-001). In the event of any inconsistency between documents, the Service Agreement prevails unless otherwise agreed in writing.
